PROVISO COLLEGE ONLINE COURSES TERMS & CONDITIONS

Organisations and individuals booking compliance courses for their employees to meet the requirements of the OHS Act or individuals booking full qualifications enter this General Terms and Conditions (“Agreement”) with Proviso Training College, hereinafter referred to as “the College.” The individuals involved, including the student, applicant, account/fee payer, lawful guardian, and/or sponsor, collectively referred to as the “Student,” acknowledge that by enrolling in any course provided by Proviso Training College, they are bound by the terms and conditions detailed herein.”

1. REGISTRATION & CANCELLATION

The College reserves the right to cancel a student’s registration without providing a reason for such cancellation. Please refer to clause 5; another example will be disruptive behaviour. Students enrolled in monthly payment plans are not eligible for a refund if the College cancels their registration. Suppose a student has paid for a course in advance and the College cancels their registration. In that case, students are not automatically entitled to a refund and each case will follow the guidelines outlined in our Refund policy.

Suppose a Student desires to terminate their studies for any reason. In that case, this shall not absolve the student from total liability for paying fees and other charges, as specified in the cancellation and refund policy.

No cancellation of this contract shall be valid without the written consent of an authorised officer of the College.

The right to tuition and examinations is non-transferable.

Without prior notification, the College reserves the right to vary the course syllabus cancel courses, or subjects due to insufficient demand.

Courses are to be paid in full before the registration or course can take place unless a monthly instalment contract for larger courses is agreed upon.

2. CAPACITY TO ENTER INTO AGREEMENT

For an organisation: The contracting party (the organisation) warrants that the signatory representing the organisation has the legal capacity to enter into and be bound by these terms and conditions.

For an individual: The Student declares that there is no legal impediment to entering this agreement and accepts all the terms and conditions herein.
3. PERSON DEALING WITH THE COLLEGE ON THE STUDENT’S BEHALF

The College will only correspond and deal with the student relating to full qualifications. The College will not enter correspondence with any person or organisation representing the student except for specific authorised entities, such as the Ombudsman, a parent or legal guardian (in the case of a minor Student), relevant accrediting bodies, or the student’s lawyer.

The College will only correspond and deal with the organisations arranging group training on behalf of the students regarding compliance courses regulated by the Occupational Health and Safety Act, ISO Standard or IOHS.

The College will not engage in further servicing, communication, or correspondence with a student once the student cancels their registration or has had their registration revoked by the College or organisation.
4. CLIENT DATA

The student undertakes to notify the College, in writing, of any changes in contact details within 7 days of such changes. Failure to do so may result in missed communications and study material deliveries.

The nominated address provided during registration will serve as the domicilium citandi et executandi for all purposes arising from this agreement.
5. ADHERING TO PRE-REQUISITE CRITERIA

The Student/Organisation is responsible for ensuring they are registered for the correct course and adhere to the latest pre-requisite criteria. The College will not accept students who do not meet the pre-requisite criteria for their chosen courses and may cancel their registration.

Organisations may replace the student with a delegate that meets the criteria of the chosen course in terms of the compliance courses required by organisations by the Occupational Health and Safety Act in writing to the College before the training commences.
6. STUDY MATERIAL

Updates to Study Material: The College will provide study material according to the course list at the time of the student’s enrolment. The College is not responsible for issuing study material based on outdated course lists.

Missing or Incorrect Study Material: Students have 30 days to query missing or incorrect study material. After 30 days, the student will be liable for the costs of replacing or resending the correct study material, should this be applicable.
7. STUDENT FEES

Registration Fees: A non-refundable registration fee is payable upfront if fees are paid in monthly instalments. The registration fee represents an initial deposit and contributes to the activation of the course.

Programme Fees: The student is responsible for payment of all fees and charges due to the College. Programme fees exclude external institute membership fees.

Extension Fees: Students needing an extension to complete their studies will be required to pay an extension fee. Additional fees may apply for curriculum changes and replacement of study material.

Exam Fees: Exam rewrite fees apply if a student is absent from an exam or fails an exam. These fees are non-refundable.

Suppose a student fails to complete a compliance course or is deemed not yet competent. In that case, a rewrite must be completed within 14 working days from the course’s conclusion to exempt any associated fees. The request for a rewrite should be submitted in writing to the College. The full course fee will apply if the rewrite is not conducted within this timeframe.
8. CHANGE OF COURSE

The College may assist Students who wish to change their course. One change of course is permitted per student, and one free change of course is offered within the first 2 months of registration.

After 2 months, application, acceptance, library, and program fees will be deducted from account credits. The remainder of the unutilised credit portion will not be refunded, and the student can utilise it for their next course enrolment.

If a course change results in a higher price, the student will be invoiced for the price difference.
9. CANCELLATION & REFUND POLICY

Students dissatisfied with college services may request cancellation. Cancellation requests must be made in writing to an authorised College representative.

Cancellation and refund will follow the terms and conditions set out in the College’s Refund policy, which is available upon request.

The College may retain a reasonable cancellation fee, as specified in the Consumer Protection Act (CPA), to cover administrative and other costs.
10. PROTECTION OF PERSONAL INFORMATION (POPIA)

The student authorises the College to process and use their personal details for study-related purposes and communication. The College will adhere to information security measures to protect students’ personal information and privacy.

11. OTHER

The College reserves the right to use Student information for providing materials, performing obligations, and enforcing rights under this agreement.

This agreement is subject to acceptance by the College and constitutes the entire agreement between the Parties.
12. SIGNATURES & AGREEMENT

By accepting the quotations and the registration process through the submission of an enrolment or booking form, the student confirms the following.

The information in the application is complete and correct.

Authorisation for the College to verify information and make necessary inquiries.
-
Agreement to abide by College policies and rules.
-
Acknowledgement that no certificates or statements of results will be released until full payment for monthly instalment contracts has been finalised and paid off by the student

If applicable, the Parent/Guardian permits the student to enroll at the College.

Acknowledgement of reading and understanding these terms and conditions.

Agreement that the student enters into a legally binding contract by completing the registration process
